Kullanım Şartları

Paneliva hizmetinin Ali Poyraz ("Paneliva" markası ile) tarafından hangi koşullarla sunulduğunu açıklar.

1. Taraflar ve kapsam

Bu şartlar, Paneliva hizmetini sunan Ali Poyraz ("Paneliva" markası ile) ile hizmeti kullanan gerçek veya tüzel kişi ("Kullanıcı") arasındaki ilişkiyi düzenler.
Hesap oluşturan kişi, kendi adına ve temsil ettiği kurum adına bu şartları kabul etmiş sayılır.
Kullanıcı, hizmet üzerinden kendi müşterilerinin verilerini işliyorsa, o veriler bakımından veri sorumlusu Kullanıcı'dır; Paneliva veri işleyen sıfatıyla hareket eder.

Paneliva; dijital pazarlama verilerinin toplandığı, raporlandığı ve yapay zekâ desteğiyle yorumlandığı bir web uygulamasıdır.
Hizmet, üçüncü taraf platformların (Meta, Google, TikTok, LinkedIn, WooCommerce, Shopify, Mailchimp ve benzerleri) API'lerine bağlanarak çalışır. Bu platformların erişim politikaları, kotaları veya arayüzleri değiştiğinde ilgili özellikler geçici veya kalıcı olarak etkilenebilir.
Yapay zekâ ile üretilen yorum, öneri ve raporlar BİLGİLENDİRME amaçlıdır; kesin doğruluk taahhüdü içermez ve profesyonel danışmanlık yerine geçmez.

Kullanıcı, hesap bilgilerinin gizliliğinden ve hesabı üzerinden yapılan tüm işlemlerden sorumludur.
Yönetici hesapları için iki adımlı doğrulama (2FA) zorunludur.
Yetkisiz bir erişimden şüphelenilmesi hâlinde durum gecikmeksizin bildirilmelidir.

Hizmet; yürürlükteki mevzuata, üçüncü taraf platformların kullanım şartlarına ve genel dürüstlük kurallarına aykırı biçimde kullanılamaz.
Kullanıcı; sisteme aşırı yük bindirmeye, güvenlik önlemlerini aşmaya, başka kullanıcıların verilerine erişmeye ya da hizmeti tersine mühendislikle çoğaltmaya yönelik işlemler yapamaz.
Kullanıcının hizmete yüklediği içeriklerden ve bunların hukuka uygunluğundan Kullanıcı sorumludur.

Abonelik planları ve yapay zekâ kredileri, hesap oluşturma sırasında ve panel içinde belirtilen koşullarla sunulur.
Yapay zekâ işlemleri kredi tüketir; tüketim, işlem sırasında hesaplanır ve hesap hareketlerinde görüntülenebilir.
Fiyatlandırma ve kredi kuralları değişebilir; değişiklikler yürürlüğe girmeden önce duyurulur.

Kullanıcı, kendi reklam ve analiz hesaplarını hizmete kendi rızasıyla bağlar; bağlantı istediği anda panelden kaldırılabilir.
Üçüncü taraf platformlardan alınan veriler yalnızca Kullanıcı'ya raporlama ve analiz sunmak için kullanılır.
Bağlantı kaldırıldığında ilgili erişim belirteçleri (token) silinir; daha önce alınmış anlık görüntüler saklama süresi boyunca kalabilir.

Hizmet "olduğu gibi" sunulur; kesintisiz veya hatasız çalışacağına dair açık ya da örtülü bir garanti verilmez.
Üçüncü taraf platformlardan kaynaklanan kesinti, kota veya politika değişikliklerinden doğan sonuçlardan sorumluluk kabul edilmez.
Mevzuatın izin verdiği azami ölçüde, dolaylı zararlardan ve kâr kaybından sorumluluk kabul edilmez.

Kullanıcı hesabını dilediği zaman kapatabilir.
Bu şartların ağır ihlali hâlinde hesap askıya alınabilir veya kapatılabilir; mümkün olan hâllerde önceden bildirim yapılır.
Hesap kapandığında veriler, Gizlilik Politikası'nda belirtilen saklama ve silme kurallarına göre işlenir.

Bu şartlar hizmetle birlikte güncellenebilir. Önemli bir değişiklikte sayfanın altındaki güncelleme tarihi değişir ve kullanıcılar bilgilendirilir.
Değişiklikten sonra hizmeti kullanmaya devam etmek, güncel şartların kabulü anlamına gelir.

Uyuşmazlıklarda Türkiye Cumhuriyeti hukuku uygulanır ve yetkili mahkeme, şirket kaydı tamamlandığında bu maddeye eklenecektir.

How the Paneliva service is provided by Ali Poyraz (operating under the "Paneliva" brand).

These terms govern the relationship between Ali Poyraz (operating under the "Paneliva" brand), who provides the Paneliva service, and the natural or legal person using it (the "User").
The person creating an account accepts these terms on their own behalf and on behalf of the organisation they represent.
Where the User processes their own clients' data through the service, the User is the data controller for that data; Paneliva acts as a data processor.

Paneliva is a web application that collects, reports and interprets digital marketing data with AI assistance.
The service connects to third-party platform APIs (Meta, Google, TikTok, LinkedIn, WooCommerce, Shopify, Mailchimp and similar). If those platforms change their access policies, quotas or interfaces, the related features may be affected temporarily or permanently.
AI-generated commentary, recommendations and reports are INFORMATIONAL; no guarantee of accuracy is given and they do not replace professional advice.

The User is responsible for keeping account credentials confidential and for all activity carried out through their account.
Two-factor authentication (2FA) is mandatory for administrator accounts.
Any suspected unauthorised access must be reported without delay.

The service may not be used in breach of applicable law, of third-party platform terms, or of general principles of good faith.
The User may not overload the system, circumvent security measures, access other users' data, or reverse engineer the service.
The User is responsible for the content they upload and for its lawfulness.

Subscription plans and AI credits are offered on the terms stated at sign-up and inside the panel.
AI operations consume credits; consumption is calculated at the time of the operation and is visible in account activity.
Pricing and credit rules may change; changes are announced before taking effect.

The User connects their own advertising and analytics accounts with their own consent; a connection can be removed from the panel at any time.
Data obtained from third-party platforms is used solely to provide reporting and analysis to the User.
When a connection is removed the related access tokens are deleted; snapshots taken earlier may remain for the stated retention period.

The service is provided "as is"; no express or implied warranty of uninterrupted or error-free operation is given.
No liability is accepted for consequences arising from third-party platform outages, quotas or policy changes.
To the maximum extent permitted by law, no liability is accepted for indirect damages or loss of profit.

The User may close their account at any time.
In case of a serious breach of these terms the account may be suspended or closed; prior notice is given where possible.
On closure, data is handled according to the retention and deletion rules set out in the Privacy Policy.

These terms may be updated along with the service. On any material change the update date at the bottom of the page is changed and users are informed.
Continuing to use the service after a change constitutes acceptance of the updated terms.
