Paneliva, tescilli bir ticaret unvanı olmayan bir şahıs işletmesi tarafından işletilen bir marka adıdır. Hukuki muhatap yukarıda adı geçen gerçek kişidir.

Paneliva ne yapar

Paneliva, dijital pazarlama ajanslarının kendi müşterilerine ait reklam, arama ve web sitesi verilerini tek panelde toplamasını, bu verilerden raporlar üretmesini ve müşterilerinin yapay zekâ arama motorlarındaki görünürlüğünü ölçmesini sağlayan bir yazılım hizmetidir.

Bu yapıda üç ayrı taraf bulunur:

1. Paneliva — yazılımı sunan taraf
2. Ajans — Paneliva'ya abone olan ve paneli kullanan işletme
3. Ajansın müşterisi — ajansın panele eklediği işletme

Ajansın panele eklediği müşteri verileri bakımından ajans veri sorumlusu, Paneliva ise veri işleyen konumundadır. Paneliva'nın kendi kullanıcılarına (ajans yetkilileri ve personeli) ait veriler ile Paneliva'nın kendi web sitesi üzerinden topladığı veriler bakımından ise Paneliva veri sorumlusudur.

İşlenen kişisel veriler

İşleme amaçları

Kişisel veriler aşağıdaki amaçlarla işlenir:

• Hizmetin sunulması, kullanıcı hesaplarının oluşturulması ve yönetilmesi
• Ajansın müşterilerine ait pazarlama verilerinin toplanması, saklanması ve raporlanması
• Abonelik ilişkisinin kurulması, ödeme süreçlerinin yürütülmesi ve faturalandırma
• Hizmet güvenliğinin sağlanması, kötüye kullanımın önlenmesi
• Kullanıcı taleplerinin ve başvuruların yanıtlanması
• Yasal yükümlülüklerin yerine getirilmesi

Hukuki sebepler

İşleme faaliyetleri KVKK m.5 kapsamında şu sebeplere dayanır:

• Sözleşmenin kurulması veya ifası için gerekli olması
• Veri sorumlusunun hukuki yükümlülüğünü yerine getirmesi
• İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla veri sorumlusunun meşru menfaati
• Açık rıza (yalnızca rızaya dayalı işlemeler bakımından)

Verilerin aktarıldığı taraflar ve aktarım amacı

Hizmetin sunulabilmesi için kişisel veriler, aşağıdaki kategorilerdeki hizmet sağlayıcılarına aktarılabilir. Güncel liste ve her sağlayıcıya aktarılan veri türü Alt İşleyen Listesi'nde yayımlanır.

Bugün fiilen bağlantı kurulan platformlar şunlardır: Meta (Facebook ve Instagram), Google (Ads, Search Console, Analytics, Business Profile, Calendar, Places), LinkedIn, TikTok, WooCommerce, Shopify, Mailchimp, DataForSEO ve yapay zekâ sağlayıcıları Anthropic ile OpenAI.

Ödeme kuruluşu bağlantısı henüz kullanılmamaktadır; başvuru süreci devam etmektedir.

Bugün platform üzerinden canlı bir ödeme tahsilatı yapılmamaktadır. Ödeme altyapısı devreye girdiğinde, kart bilgileriniz güvenli bir bağlantı üzerinden alınır ve yetkili ödeme kuruluşuna iletilir; tarafımızda yalnızca işlemi tanımlayan bir referans (token), kartın son dört hanesi ve kart tipi saklanır. Kart numarası ve güvenlik kodu (CVC) sistemlerimizde saklanmaz.

Yurt dışına aktarım

Uygulama ve veritabanı Türkiye içinde barındırılmaktadır. Ancak rapor üretimi ve görünürlük ölçümü için kullanılan yapay zekâ servis sağlayıcıları ile bazı altyapı hizmetleri yurt dışında yerleşiktir. Bu kapsamda kişisel veri içeren içerikler, hizmetin sunulabilmesi için KVKK m.9 çerçevesinde yurt dışına aktarılabilir.

Rapor üretimi ve görünürlük ölçümü için kullandığımız yapay zekâ ve veri sağlayıcıları şunlardır: OpenAI, Anthropic ve DataForSEO (Perplexity ve Google AI Mode sorguları DataForSEO üzerinden yapılır). Google Gemini'nin altyapısı hazırdır, ancak bugün kullanılmamaktadır.

Yapay zekâ servislerine gönderilen içerik, rapor üretimi için gereken pazarlama metrikleriyle ve bu metriklerin ait olduğu işletmenin adıyla sınırlıdır.

Web sitemizin yazı tipleri, yurt dışında yerleşik bir yazı tipi sağlayıcısından yüklenmektedir; bu yükleme sırasında ziyaretçinin IP adresi ilgili sağlayıcıya ulaşır.

Saklama süreleri

Kişisel veriler, işlendikleri amaç için gerekli olan süre boyunca ve ilgili mevzuatta öngörülen asgari süreler kadar saklanır. Sürenin dolması hâlinde veriler silinir veya anonim hâle getirilir.

Panelde otomatik olarak uygulanan saklama süreleri şunlardır:

Güvenlik

Platform yöneticisi hesapları için iki faktörlü kimlik doğrulama zorunludur. Kritik işlemler (silme, plan değişikliği, kimlik bilgisi güncelleme gibi) denetim günlüğüne kaydedilir ve bu kayıtlar değiştirilemez.

İlgili kişinin hakları

KVKK m.11 uyarınca her ilgili kişi;

• Kişisel verisinin işlenip işlenmediğini öğrenme
• İşlenmişse buna ilişkin bilgi talep etme
• İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme
• Yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme
• Eksik veya yanlış işlenmişse düzeltilmesini isteme
• Silinmesini veya yok edilmesini isteme
• Düzeltme, silme ve yok etme işlemlerinin aktarıldığı üçüncü kişilere bildirilmesini isteme
• Münhasıran otomatik sistemlerle analiz edilmesi suretiyle aleyhine bir sonuç ortaya çıkmasına itiraz etme
• Kanuna aykırı işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme

haklarına sahiptir.

Başvurular, kimliğinizi tevsik edici bilgilerle birlikte privacy@paneliva.com adresine elektronik olarak veya Rızaiye Mah. 10049 Sk. No: 67 İç Kapı No: 2, Merkez / Osmaniye adresine yazılı olarak iletilebilir.

Başvurular en geç otuz gün içinde sonuçlandırılır. Talebin niteliğine göre ücret alınabilecek hâller saklıdır.

Information Notice on the Processing of Personal Data (KVKK)

Data controller

Turkey's Personal Data Protection Law No. 6698 ("KVKK") requires us to identify the data controller. The party acting as data controller is:

Paneliva is a brand name operated by a sole proprietorship that has no registered trade name. The legal counterparty is the individual named above.

What Paneliva does

Paneliva is a software service that lets digital marketing agencies bring their own clients' advertising, search and website data together in a single panel, produce reports from this data and measure their clients' visibility in AI search engines.

There are three separate parties in this structure:

1. Paneliva — the party that provides the software
2. Agency — the business that subscribes to Paneliva and uses the panel
3. Agency's client — the business that the agency adds to the panel

For client data that an agency adds to the panel, the agency is the data controller and Paneliva is the data processor. For data belonging to Paneliva's own users (agency officers and staff) and data that Paneliva collects through its own website, Paneliva is the data controller.

Personal data we process

Why we process personal data

We process personal data to:

• provide the service, and create and manage user accounts
• collect, store and report marketing data belonging to agencies' clients
• set up the subscription relationship, run payment processes and issue invoices
• keep the service secure and prevent misuse
• respond to user requests and applications
• meet our legal obligations

Legal grounds

We rely on the following legal grounds recognised by Turkish data protection law (KVKK, Article 5):

• the processing is necessary to enter into or perform a contract
• we must comply with a legal obligation
• our legitimate interests, provided they do not harm your fundamental rights and freedoms
• your explicit consent (only for processing that is based on consent)

Who we transfer data to, and why

To provide the service, personal data may be transferred to service providers in the categories below. The current list, and the type of data transferred to each provider, is published in the Sub-processor List.

The platforms actually connected today are: Meta (Facebook and Instagram), Google (Ads, Search Console, Analytics, Business Profile, Calendar, Places), LinkedIn, TikTok, WooCommerce, Shopify, Mailchimp, DataForSEO and the artificial intelligence providers Anthropic and OpenAI.

The payment institution connection is not in use yet; the application process is ongoing.

No live payment collection is carried out through the platform today. When the payment infrastructure goes live, your card details are transmitted over a secure connection to an authorised payment institution; we retain only a transaction reference (token), the last four digits of the card, and the card type. Your full card number and security code (CVC) are never stored in our systems.

Transfers outside Türkiye

The application and database are hosted in Türkiye. However, the artificial intelligence service providers used for report generation and visibility measurement, and some infrastructure services, are based outside Türkiye. For this reason, content that includes personal data may be transferred abroad so that the service can be provided, as permitted for cross-border transfers under Turkish data protection law (KVKK, Article 9).

The artificial intelligence and data providers we use for report generation and visibility measurement are OpenAI, Anthropic and DataForSEO (Perplexity and Google AI Mode queries are made through DataForSEO). The infrastructure for Google Gemini is in place, but it is not in use today.

The content sent to artificial intelligence services is limited to the marketing metrics needed to generate reports and the name of the business those metrics belong to.

The fonts on our website are loaded from a font provider based outside Türkiye; when they load, the visitor's IP address reaches that provider.

How long we keep data

Personal data is kept for as long as the purpose for which it is processed requires, and for at least the minimum periods set by the applicable legislation. When that period ends, the data is deleted or anonymised.

The retention periods applied automatically in the panel are:

Security

Two-factor authentication is mandatory for platform administrator accounts. Critical operations (such as deletions, plan changes and credential updates) are recorded in the audit log, and these records cannot be altered.

Your rights

Turkish data protection law (KVKK, Article 11) gives every data subject the following rights. You can:

• find out whether your personal data is being processed
• ask for information about that processing
• learn why your data is processed and whether it is used for that purpose
• know which third parties, in Türkiye or abroad, your data has been transferred to
• have incomplete or inaccurate data corrected
• have your data deleted or destroyed
• ask that any correction, deletion or destruction is passed on to the third parties your data was transferred to
• object to a decision against you that results solely from automated analysis
• claim compensation if you suffer damage because your data was processed unlawfully

How to exercise your rights

You can send your request, together with information that verifies your identity, by email to privacy@paneliva.com or in writing to Rızaiye Mah. 10049 Sk. No: 67 İç Kapı No: 2, Merkez / Osmaniye, Türkiye.

Requests are concluded within thirty days at the latest. Depending on the nature of the request, a fee may be charged in the cases allowed by Turkish law.
